Framework conditions for training (Terms and Conditions)

These general terms and conditions apply to all training and event contracts between Feelings Practitioner Trainers (Dagmar Thürnagel, Michael Samoto Hallinger, Katharina Kaifler, and Michaela Kaiser) and their clients.

These general terms and conditions (GTC) apply exclusively. Terms and conditions of the contractual partner that conflict with these, deviate from them or deviate from the legal regulations to the detriment of Feelings Practitioner Trainers will not be recognized unless their validity is explicitly agreed upon in writing.

1. Conclusion of contract

With the registration for a training by the client (written registration for a training or booking of another event; also by e-mail) a binding offer is made. A contract is concluded by the written (also by e-mail) acceptance (confirmation of registration) of this offer by Feelings Practitioner Trainer and the payment of the deposit (for trainings lasting several days, see also 3).

If the content of the confirmation of registration differs from the content of the order, a new offer is made to which Feelings Practitioner Trainers are bound for a period of 14 days. The contract is concluded on the basis of this offer if the client accepts this offer within this period. Bookings are therefore binding.

2. Scope of the service

The scope of the service is determined on the basis of the respective training or event contract. No guarantee is given for a training course subjectively presented by the client.

Feelings Practitioner Trainers reserve the right to make changes to the service after the start of the training for reasons of more effective and efficient goal achievement in the interests of the client.

3. Fee claim / payment

Feelings Practitioner Trainers are entitled to payment of an appropriate fee by the client in return for the provision of their services. The fee is contractually agreed upon.

In the case of trainings lasting several days, the client will receive a request to pay a deposit of 150 € towards the training fee with the confirmation of registration. The place in the training is reserved once this payment has been received.

The client will receive an invoice prior to the training, which must be paid within the payment period specified therein, less the deposit paid. If the client is in arrears with payment, the service can be postponed to another date (see also point 4).

4. Termination / cancellation of individual training courses by the client(s)

Withdrawal from the contract must be made in writing or by e-mail. This will incur a cancellation fee in the amount of the deposit of 150 €. Where appropriate, this can be credited to a later training.

Feelings Practitioner Trainers have to book contingents in seminar houses and usually have to bear the costs in case of a cancellation. Therefore, the flat rates for accommodation and meals in the seminar house as well as pro rata costs for premises will be charged in such a case and are to be paid by the client if the place cannot be filled otherwise (e.g. by a substitute person provided by the client). The deadlines and cancellation fees of the seminar house will be passed on to the client.

5. Termination / cancellation of individual trainings by the Feelings Practitioner Trainer

The organizer may cancel the training or event for good cause, e.g. if the trainer is ill or the number of participants is too low. In this case, any fees already paid will be refunded in full or a new date will be arranged after consultation with the client. Feelings Practitioner Trainers are not liable in this case for already booked travel by car (e.g. rental car), train or plane.

6. Training requirements / disclaimer

Dagmar Thürnagel, Michael Samoto Hallinger, Katharina Kaifler, and Michaela Kaiser work as trainers and Feelings Practitioners, a specialization in the context of Possibility Management. They teach participants new possibilities, techniques and processes that promote development and self-healing. Dagmar Thürnagel and Katharina Kaifler are neither alternative practitioners nor psychotherapists and are no substitute for them. Michael Samoto Hallinger and Michaela Kaiser are neither acting as medical practitioners nor alternative practitioners. Feelings Practitioner Trainings are not a substitute for therapy or medical treatment. Participants take part at their own responsibility and risk. Each participant is their own authority at all times and bears full responsibility for their participation and actions. Feelings Practitioner Trainers are not liable for any damage resulting from the participant's failure to comply with the instructions of Feelings Practitioner Trainers. Feelings Practitioner Trainers are also not liable for damage caused by the participant to themselves or other third parties. Feelings Practitioner Trainers are liable within the scope of their duty of care for the conscientious preparation, careful selection and proper provision of the agreed service. With the exception of damage caused by gross negligence or intent, claims for damages by the participant(s) against Feelings Practitioner Trainers are excluded. These points apply to both indoor and outdoor events. By participating in a Feelings Practitioner Training or a Feelings Practitioner Session, the participant automatically accepts these General Terms and Conditions (GTC). In addition to these terms and conditions, the separate notes on participation in trainings and sessions apply.

7. Ancillary agreements

Ancillary agreements must be agreed upon in writing.

8. Invalidity of individual provisions

Should individual provisions of the contract with the contractual partner, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. Wholly or partially invalid provisions shall be replaced by a provision whose economic success comes as close as possible to the invalid provision.

Notes on participation in trainings and sessions by Feelings Practitioner Trainers

Dagmar Thürnagel, Katharina Kaifler, Michael Samoto Hallinger, and Michaela Kaiser work as Feelings Practitioner Trainers and teach participants new possibilities, techniques and processes for development and self-healing in trainings and sessions. Each participant is their own authority at all times and bears full responsibility for their participation and actions.

Please read the following text carefully:

  • In the course of training and sessions, an intensive learning process takes place and physical, mental, emotional and energetic reactions can occur. Learning something new can trigger strong feelings. The participant acknowledges this and agrees that they take full responsibility for any automatic reactions that may arise for them during this learning process. They also accepts 100% responsibility to take care of their physical, mental, emotional and energetic well-being.
  • Dagmar Thürnagel and Katharina Kaifler are neither alternative practitioners nor psychotherapists and do not replace them. Michael Samoto Hallinger and Michaela Kaiser do not work as non-medical practitioners. Ongoing treatments and therapies should not be interrupted or discontinued and future ones should not be postponed or omitted. The training and sessions are intended for personal development and support the self-healing process. They do not constitute medicine and are not a substitute for medical and/or psychotherapeutic treatments.
  • No diagnoses, therapies or treatments in the medical sense are carried out or other healing in the legal sense is practiced or promises of healing are made. The trainings and sessions offered are holistic training courses. The participant takes part in a training or session on the condition that they are not aware of any health conditions or restrictions and that there are no other medical indications that would preclude participation in a training course or session.
  • The trainers only go as far as the participant is prepared to go, i.e. they take responsibility for the speed of their own development, especially in the case of individual sessions, the course is largely determined by the participant.
  • By participating in a training or session, the participant agrees that they have read, understood and acknowledged the above information and the provider's general conditions. Furthermore, they agree that they have voluntarily decided to participate in a Feelings Practitioner training or session and know that they bear full responsibility for themselves and their own actions during and after a training or session.
